			<content:encoded><![CDATA[<p><span style="text-decoration: underline;"><strong>What is a bank owned foreclosure?  </strong></span>A bank-owned foreclosure is a home that has gone into foreclosure because the previous (or current) owner has not kept current on the required payments.  When an owner does not maintain current payments that are required on a property, then in short order his home may become a Bank Owned Foreclosure.  In some cases the owner will simply return the deed to the bank to avoid the long drawn out and expensive foreclosure process.  If the bank feels that they will lose less by taking the deed and foregoing the long process of foreclosure then it may work out well for the home owner. In many cases, the bank will forgive the owner any credit trashing and indebtdness that normally comes along with a foreclosure.</p>
<p>Now the bank owns the property and very few banks are in the real estate business, so they must  do as much as possible to get rid of the property as quickly as possible.  Otherwise the expense of  maintaining the property and provding security becomes overwhelming.   As a need to get rid of the property, causes the bank to be willing to take in some cases less than what the property is actually worth.  This means an alert buyer can get the property at a very good price.</p>

<p>Normally the reason we are requried to negotiate, is caused by the contract being riddled with what we call a contingency.  When your agent brings you a contract with a contingency then the  negotiation process begins.  First let me define what a contingency really is&#8230; it is basically a condition that has been added to the agreement that must be either agreed to or modfied by either party and then agreed to by both parties.. Confusing huh?  Well.. yes, but in the skillful hands of an experienced All Pros Realty agent it becomes a lot less complex.</p>
<p>Contingencies are very common in regard to real estate transactions. As a matter of fact contingencies are one of the most common reason that a contract fails to close.  A good negotiator knows that each party must feel that they have won something if the deal is expected to close.  Somtimes the contingency is minor, and sometimes it major.  When the parties are too far apart, the deal falls through.  All of our All Pros Realtors have had in depth training in the art of negotiation and if one of our experts cannot pull the deal throug then it was just not meant to be.</p>
<p>One of the more common contingencies that we see almost on a daily basis is when the purchase is contingent on the selling of the home that a buyer owns. In other words they want to buy our home, but will not be able to close until they have at least a solid contract on their home.  This is also one of the most difficult to solve. Asking the seller to tie up their home while there is no guarantee that the home will close.  The seller must be in very high need to sell to allow this sort of contingency.</p>
<p>Probably the second most common contingency is when the buyer adds that &#8220;A guarantee that they can walk away if the homes does not appraise for the offered price.  However sometimes the seller can then reduce the price to the appraised value if he so desires, additionally sometimes the negotiator can convince the buyer to pay half the difference and the seller to take half the difference and both go away happy.</p>

This is when you purchase a property, and the government guarantees the loan so that you may borrow the money for the fix up in the same loan.  The maximum units that can be contained in a property and still qualify for a 203k loan is 4. Meaning a 4 plex. A home that has been demolished and razed as part of the rehab process is eligible as long as a portion of the original foundation remains as part of the new construction.</p>
<p>It is also acceptable to move a new home no the the mortgaged property but it is required that the proceeds from the sale of the previous location not be released until the properly inspected foundation is securely attached to the new foundation.</p>
<p>Some of the conversions of property include:</p>
<p>1. Single family property to two unit property (duplex).</p>
<p>2. Single family property to three unit (triplex).</p>
<p>3. Single family property to four unit (four plex).</p>
<p>4. Two unit property to four unit property (duplex to four plex).</p>
<p>But keep in mind you cannot exceed the maximum of four units and one of the units must be owner occupied.  At this time cooperatives are NOT eligible for the 203k loan program..</p>

			<content:encoded><![CDATA[<p>I am frequently asked, &#8220;What exactly is a short sale? It can be a simple process, or a long hard drawn out process.  Either way it may not be an easy task to swallow.  Virginia Beach always has a lot of homes in the short sale market, as does most any other neighborhood in the Nation.  Normally when the proceeds of a sale of real estate fall below that of the amount owed on the property, it falls into the category of what is called a short sale.</p>
<p>In this case the lender (bank or mortgage company) may be willing to discount the loan balance due to a financial or economical hardship that prevents the current owner to make the normal payments that are due every month.</p>
<p>At anytime of the day, there is generally more than 150+ homes on the market and listed as a short sale.  In many cases the buyer can get a real deal in the purchase of a short sale, but the disadvantage is that there is usually a major delay in closing most short sales.  In many cases the short sale can take more than 30 days to close. In some cases it can exceed 6 months when major difficulties are uncovered.</p>
<p>If you have the time and patience, you can potentially make a real deal on a short sale.</p>
